Terms and conditions

1. Contest Details, Concept and Participation:

(i)These terms and conditions apply to the “Sterling Reserve Blend 7 Come Alive Contest” for participants (hereinafter referred to as "Contest") sponsored and launched by Allied Blenders and Distillers Limited wherein participants can participate by visiting the weblink www.sterlingreserve.bigcityexperience.com Persons participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".

(ii)The Contest is valid to all eligible residents of India who are residing in the states where the product being the 750ml bottle of Limited-Edition Sterling Reserve Blend 7 Illusion Pack of Allied Blenders and Distillers Limited is sold through licensed vendors. However, the residents of Tamil Nadu, Gujarat, Mizoram, Nagaland and Bihar are not eligible to participate in the Contest. The Contest shall be valid from 00: 00:00 AM of 01/08/2022 to 23: 59:59 PM of 30/10/2022 (hereinafter referred to as "Contest Period").

(iii) During the Contest Period, upto 10,920 Prizes will be awarded to the winners of the Contest during the Contest Period. Each shortlisted winner shall be eligible for a Prize subject to the conditions duly fulfilled by the shortlisted winner.

(iv) All intellectual property rights (“IPR”) including trademark, copyright, and designs used are the properties of their respective owners. It is clarified that Allied Blenders and Distillers Limited is the exclusive owner of the brand, Sterling Reserve Blend 7 along with all IPR therein.

(v) The Contest is subject to all applicable central, state and local laws, rules and regulations.

2. Agreement to Terms and Conditions:

(i) By participating in the Contest, Participants fully, irrevocably and unconditionally agree to and accept these Terms and Conditions available on www.sterlingreserve.bigcityexperience.com ("Contest Website") including any/all amendments, modifications, etc. made thereto, without demur as well as the decisions of Allied Blenders and Distillers Limited, as final and binding in all matters related to the Contest. The Participants agree and acknowledge that successfully entering the Contest and winning a prize is subject to all requirements set forth herein.

(ii) Allied Blenders and Distillers Limited reserves the right to exclude any person from the contest on grounds of misconduct or criminal record.

(iii) Allied Blenders and Distillers Limited reserves the right to terminate, modify or extend the Contest, at any time at its absolute discretion, without assigning any reason. All decisions of Allied Blenders and Distillers Limited in respect of the Contest and the prizes therein will be final and binding.

3. Eligibility:

(i) This Contest will be open to all the residents of India above the legal drinking age in their respective states/union territories of residence where the product being the 750ml bottle of Limited Edition Sterling Reserve Blend 7 Illusion Pack of Allied Blenders and Distillers Limited is sold through licensed vendors. It is clarified that no person being a resident of the State of Tamil Nadu, Mizoram, Nagaland Bihar and Gujarat shall participate in the Contest.

(ii) Employees, their immediate family members, agents, distributors, retailers and any other channel partners of Allied Blenders and Distillers Limited and Premier Sales Promotions Pvt. Ltd. (“Agency”) are not eligible to participate in the Contest.

(iii) Allied Blenders and Distillers Limited or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), Allied Blenders and Distillers Limited and/ or its Agency will have all the authority to call such winners by virtue of them having voluntarily participated in the Contest.

4. Contest Period & Contest Timings:

(i) The Contest will commence from 00:00:00 AM on 15/07/2022 to 11: 59:59 PM on 30/09/2020 and shall be open during the entire duration of the Contract Period.

(ii) Time of participation will be defined as the time at which the Agency’s computer systems have received the Participant relevant details as submitted on the website.

(iv) Entries submitted outside the Contest Period or invalid/ incomplete/ incorrect entries or entries not meeting the eligibility criteria above will not be considered for winner selection.

(v) The Contest shall run on select SKU of the brand, Sterling Reserve Blend 7 only. Packs without the offer are also available in the market.

6. Prize

a. Participants will be chosen between 12:00:01 AM on 01/08/2022 to 11: 59:59 PM on 30/10/2020 during the Contest Period and they will be eligible for a Daily reward of Rs. 100 Cashback Voucher or Weekly reward of Rs. 750 Shopping Gift Voucher. Participants will be chosen through a computerized, scientific random selection by Allied Blenders and Distillers Limited or the Agency.

Total Prizes which will be declared during the Contest Period will be as follows:

Daily prize of Rs. 100 Cashback Voucher – 10800 in number

Weekly prize of Rs. 750 Shopping Gift Voucher – 120 in number

7. How to Participate:

Any eligible Participant can enter the contest a maximum of once from a particular mobile number/email id during the Contest Period subject to following terms and conditions.

To participate in the Contest, customers have to:

(i)Purchase a 750ml bottle of the Limited-Edition Sterling Reserve Blend 7 Illusion Pack which holds the QR code for the Contest.

(ii)Scan the QR code present on the bottle to visit the website and enter their details.

(iii)The Participants will be required to watch a video and answer a few questions to submit their entry for the Contest.

(iv)If the Participant is a winner of a reward/ prize, the winner will receive a reward code and web-link within 24 to 48 business hours (excluding public holidays) to claim and redeem their reward.

Allied Blenders and Distillers Limited and the Agency shall not be responsible for (including but not limited to):

- For any SPAM generated messages

- For any SMS message delivery failures

- Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason

- If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign

- Other conditions beyond their reasonable control

8. Winner Selection:

(i) A draw through random computerized selection will be conducted on a pre-defined timetable to choose the winners.

(ii) Therefore, there will be 10920 unique winners selected to win prizes during the Contest Period of 91 days i.e. a maximum of 1 winner can be declared per mobile number and email id.

(iii) Prizes will be given subject to the winner satisfying the verification process of Allied Blenders and Distillers Limited

(iv) The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize by 11: 59:59 PM on 30/10/2022, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied.

(iv)Any unused prize is not transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

(v)Allied Blenders and Distillers Limited shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and Allied Blenders and Distillers Limited and/or its associates, affiliates and/ or its management, directors, employees, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever. If any Participant has any grievance with respect to the prize, he/she may directly contact the Agency by writing to feedback@bigcity.in.

(vi) The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.

(vii) Allied Blenders and Distillers Limited and/ or its Agency shall not be liable for any loss or damage of the prize due to Act of God, Governmental action and other Force Majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses.

(viii)Any Participant of the Contest who wins a prize during the Contest Period shall not be eligible to win any further prizes.

(ix)The winner generation will be done on the basis of the Unique mobile number + Unique Email ID

9. Contacting Winners:

PRIZE

(i) For Rs. 100 Cashback & Rs. 750 Shopping Voucher: The winners will receive their reward code along with steps to claim their reward on their winning mobile number. The winner to follow the process to claim their prize.

(ii) No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct or incomplete.

(iii) In the event of the death of the confirmed Winner, no claim from the nominee or his/her legal heirs of the confirmed Winner shall be entertained for receiving the prize.

10. Publicity:

(i) The Participant/s undertake and irrevocably and unconditionally permit Allied Blenders and Distillers Limited/ the Agency to advertise/market the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

(ii)The winners must, at the request of Allied Blenders and Distillers Limited, participate in all promotional activity (such as public appearances and photography) surrounding the winning of the prize, free of charge, and they consent to Allied Blenders and Distillers Limited using their name and image in promotional material.

11. Intellectual Property:

(i)All right, title and interest, including but not limited to IPR, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with Allied Blenders and Distillers Limited at all times. Allied Blenders and Distillers Limited or any person or entity permitted by Allied Blenders and Distillers Limited in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity, and any other purpose, without any permission and or payment to the Participant.

(ii)All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Allied Blenders and Distillers Limited upon submission and become the property of Allied Blenders and Distillers Limited exclusively. Allied Blenders and Distillers Limited may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Allied Blenders and Distillers Limited

12. General Conditions

(i) Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

(ii) The decision of Allied Blenders and Distillers Limited or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to Allied Blenders and Distillers Limited’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained.

(iii) No queries, claims, dispute, complaints or grievances shall be entertained by Allied Blenders and Distillers Limited and its Agency after 30 days from the date of the closure of the contest.

(iv) The Prize cannot be exchanged and is not transferable and cannot be converted into cash.

(v) The Agency shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and Allied Blenders and Distillers Limited and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever.

(vi) Allied Blenders and Distillers Limited reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Allied Blenders and Distillers Limited in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and non-contestable.

(vii)Nothing contained herein amounts to a commitment or representation by Allied Blenders and Distillers Limited to extend the Contest/ conduct further contest.

(viii)The decision of Allied Blenders and Distillers Limited shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and Allied Blenders and Distillers Limited and the Participant shall not have the authority to bind Allied Blenders and Distillers Limited in any manner whatsoever.

(ix) Allied Blenders and Distillers Limited or any of its respective officers/employees/directors/agents shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents, etc.

(x) Allied Blenders and Distillers Limited or its Agency shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.

(xi) Allied Blenders and Distillers Limited or it’s Agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.

(xii) Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Allied Blenders and Distillers Limited or its Agency.

(xiii) Allied Blenders and Distillers Limited or its Agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Allied Blenders and Distillers Limited or its Agents shall not be liable for any consequences of user error including (without limitation) costs incurred.

(xiv) The reward code will be sent to the winning mobile numbers within 24 to 48 business hours (excluding public holidays) of the Participant’s submission.

(xv) If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.

(xvi) If a person being a resident of India chooses to participate in the Contest while being outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country from where he is participating in the Contest.

(xvii) The participation in the Contest is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

(xviii) To participate in this contest regular call and message rates as may be applicable shall apply.

(xix) To use this offer, Standard fair usage policy and usage norms set by the respective telecom operator apply.

(xx) The Contest is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.

(xxi) The Agency/ Allied Blenders and Distillers Limited shall not be held responsible for changes in telecom plans, changes in recharge denomination by operators or government agencies. In the event that a particular recharge denomination has been discontinued by the telecom provider, Premier Sales Promotions reserves the right to offer the customer an alternative reward of equal or lower value. This would complete the Agency/ Allied Blenders and Distillers Limited’s promotional obligations to the Participant.

(xxii) The Offer is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.

13. Release and Limitations of Liability:

(i) Allied Blenders and Distillers Limited and the Agency shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of the acceptance of any prize.

(ii) By entering the Contest, the Participant hereby releases from and agrees to indemnify Allied Blenders and Distillers Limited, and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.

(iii) Allied Blenders and Distillers Limited and the Agency accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, Agency or third parties in relation to the prizes.

(iv) The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Contest by conducting an illegal act. The Participant also undertakes to indemnify Allied Blenders and Distillers Limited and/or the Agency and their respective officers, directors, employees, and agents on the happening of such an event (including without limitation cost of an attorney, legal charges, etc.) on a full indemnity basis for any loss/damage suffered by Allied Blenders and Distillers Limited or the Agency on account of such activity on the part of the Participant.

(v) In consideration of Allied Blenders and Distillers Limited allowing the Participant/s to take part in the Contest, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Allied Blenders and Distillers Limited, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Contest or related to the Contest or the prize of the Contest.

14. Dispute:

(i) The courts of competent jurisdiction at Mumbai shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Contest. Participation in the Contest is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.

(ii) Further all issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Allied Blenders and Distillers Limited and/or Partners of this Contest shall be governed and construed in accordance with the laws of the Republic of India.

Terms and Conditions – Cashback

1. This offer entitles the end user to cashback on their Online Wallet / Bank Account or UPI. The customer will be responsible for their choice of the cashback transfer method. The denomination of the cashback will be mentioned in the reward code/voucher.

2. Any eligible consumer purchasing a promotional product and submitting his entry shall be eligible to receive a reward code/ voucher. The winner shall receive a cashback of an amount equivalent to the value as mentioned in the reward code/ voucher (“Cashback/Voucher Amount”).

3. By redeeming the Offer provided on the same, a Participant agrees to be bound by the terms and conditions below (“Conditions”).

4. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt. Ltd. No claim shall lie for any redemption requests made after the expiry of the Contest Period.

5. If you are not a wallet partner registered customer, you will be required to register on the wallet partner website or Mobile App to receive your wallet cashback.

6. The customer will be responsible for entering details such as UPI ID, Account No, Online Wallet Mob Nos, etc. Premier Sales Promotions Pvt Ltd. will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the booking.

7. All Participants agree that wallet partner offering discount vouchers may at any time stipulate additional terms and conditions for redemption of the discount vouchers and such terms and conditions shall be binding on the Participants and shall apply to every redemption of recharge/discount voucher by the Participants.

8. The Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies. In the event of any fraud detection, the wallet partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.

9. The Participant acknowledges that relevant state and central taxes may be deducted by the merchant while redeeming the discount offer and therefore, the amount reflected in the voucher may not be the same as the final redemption value received by the Participant.

10. In no event shall Premiere Sales Promotions Pvt Ltd or Allied Blenders and Distillers Limited be held liable for any issues relating to the redemption of the voucher including redemption requests not being honored by the wallet partner.

11. In no event shall the maximum liability of Premier Sales Promotions Pvt Ltd and/ or Allied Blenders and Distillers Limited exceed the value of the voucher i.e. Rs. 100.

12. Any disputes or differences in connection with the offer shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Courts at Mumbai.

13. The wallet partner reserve the right to restrict cashback for any account with suspicious behavior or invalid details/credentials. The wallet partner has the right to ask for documents to prove the customer/user's identity.

14. This offer is subject to promotional availability and government regulations.

Shopping Gift Voucher Terms & Conditions

1. The E-Gift Cards can be redeemed online against Sellers listed on the partner website/App only.

2. Shopping E- Gift Card redemptions per month have been capped at Rs. 50,000 per account on the partner website/App.

3. E-Gift Cards can be redeemed by selecting the payment mode as E-Gift Card. The E-Gift Card payment option is available for single orders with multiple sellers.

4. Credit and Debit Cards issued outside India cannot be used to purchase other E-Gift Cards

5. E-Gift Cards cannot be used to purchase other Gift Cards, other SCLP Gift Cards and subscriptions.

6. E-Gift Cards cannot be used to make bulk purchases on the Partner Platform.

7. If the order value exceeds the E-Gift Card amount, the balance must be paid by Credit Card/Debit Card/Internet Banking/UPI. The Cash on Delivery payment option cannot be used to pay the balance amount.

8. If the order value is less than the amount of the Gift Card, the outstanding balance (after deduction of order value) will reflect under the same E- Gift Card and can be used for subsequent transactions.

9. E-Gift Cards cannot be redeemed for Cash or Credit.

10. E-Gift Cards issued to you on account of damaged, defective or missing products must not be transferred to any other account. BigCity/Partner reserves the right to cancel such E-Gift Cards if the same have been found to be transferred to any other account.

11. You are solely responsible for the safety and security of the E-Gift Cards. Partner/BigCity are not responsible for any acts of omission or commission if E-Gift Card is lost, stolen or used without permission.

12. Once the E- Gift Card has been sent to you, you are bound to protect the E-Gift Card PIN or E-Gift Card number as confidential. In the event of any misuse of the Gift Card due to loss of any such confidential details due to the fault of the purchaser, Partner/ BigCity shall not be responsible for the same and no refund will be issued.

13. You can combine a maximum of 15 E-Gift Cards in a single order at the time of checkout. In case you wish to redeem more than 15 Gift Cards on a single order, please add the E- Gift Cards to your Wallet.

14. Partner/BigCity assume no responsibility for the products purchased using the E-Gift Cards and any liability thereof is expressly disclaimed.

15. E-Gift Cards once purchased, cannot be cancelled by the Purchaser. Any cancellations shall be at the sole discretion of Partner/BigCity.

16. BigCity/Partner reserves the right to cancel Gift Cards if the same have been found to be purchased using fraudulent means. In such cases, the funds shall be credited back to the same source from where these were received.

17. In the event that the beneficiary/Know Your Customer ("KYC") details as per RBI Guidelines are found to be incorrect/insufficient, Partner/BigCity retain the right to cancel the Gift Card issued.

18. You agree and understand that E-Gift Cards are a pre-paid payment instrument subjected to regulations by the RBI under the RBI guidelines. Partner/ BigCity may be required to share KYC details of the purchaser/ redeemer of the E-Gift Card and/or any other information with relation to the purchase of the E-Gift Cards and/or transaction undertaken using the Gift Card with RBI or such statutory authorities.

19. Partner/ BigCity may contact the purchaser/redeemer of the Gift Card for any such information.

20. There is no fee or other charges associated with E-Gift Card purchase.

21. E-Gift Cards cannot be reloaded or resold.

22. Any offer on E-Gift Cards including offers by banks and instant cash backs could be withdrawn anytime at the sole discretion of the partner

23. In no event shall the maximum liability of Premier Sales Promotions Pvt Ltd exceed the value of the voucher i.e. Rs. 750

General Terms & Conditions

1. This Voucher entitles you to an cashback of up to Rs. 100 or Rs. 750 Shopping Gift Voucher. The gift won will be informed via SMS to the customer

2. This offer is not available to employees of Allied Blenders and Distillers Limited and Premier Sales Promotions Pvt Ltd, its clients or agencies and their immediate families.

3. The usage of this Voucher is incumbent upon the terms & conditions to be followed by the voucher holder/purchaser. Such conditions need to be followed by the voucher holder/purchaser.

4. The "How to Use/Redeem" instructions form a part of these Terms & Conditions.

5. The Promotion & contest shall run on the select SKUs only.

6. Oﬀer excludes Public Holidays and bank holidays

7. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant. Also, regular call and message rates will apply as per the consumer telecom operator in their respective circles.

8. Only one voucher code per booking will be entertained. Multiple vouchers cannot be booked together.

9. A maximum of one voucher can be used per person, per mobile number, per email id, per account during the promotion period.

10. The usage of this Voucher is incumbent upon the terms & conditions to be followed by the voucher holder/purchaser. Such conditions need to be followed by the voucher holder/purchaser.

11. Premier Sales Promotions Pvt Ltd is acting as an executing agency for this promotional offer and holds no legal and financial liability on unclaimed offers, incentives, vouchers, etc beyond the applicable period of the promotional offer.

12. This offer is subject to promotional availability and government regulations.

13. Under this promotion, the Vouchers are being offered directly by Premier Sales Promotions Pvt Ltd. Allied Blenders and Distillers Limited is not responsible either directly or indirectly with respect to any matter pertaining to this Voucher and the prize offered with this Voucher.

14. Premier Sales Promotions Pvt Ltd./ Allied Blenders and Distillers Limited reserves the right to change the terms and conditions of this scheme, including extending, withdrawing, or discontinuing the same without notice, without assigning any reason, at their sole discretion and without any liability.
